Terms of Business

1.0 Definitions

1.1 “The Academy” means The Broking Academy Ltd of 130 Fenchurch Street, London, EC3M 5DJ (Company Registration number 11729549).

“Student” means a person intending to enrol or attending a Course.

“You” means a Student.

“us”, “we” and “our” means The Academy.

1.2 “Course” means a Junior Broker Course or such other Course as The Academy may arrange from time to time.

1.3 “Course duration”: The duration of the Course, the dates of which shall be notified to the Student by The Academy.

1.4 “Placement” means a 4-week placement with Brokers.

1.5 “Fees” means the tuition and all other expenses relating to the Course, payable by the Student to The Academy.

1.6 “Online Payment Process” means the process of enrolling and paying for a course online through The Academy website.

1.7 “Terms and Conditions” means the Terms and Conditions for Course enrolment and Fee payment for Students on a Course.

 

2.0 The Contract

2.1 After booking a place, you will receive an acknowledgment from us that we have received and accepted your booking. The contract between us and you will only be formed when you receive our acknowledgement.

2.2 Payment of fees by anyone other than the Student does not constitute a contract for the provision of a Course between any third party and The Academy.

 

3. Fees and Payment

3.1 You (or a third party paying fees on your behalf) may pay the fees now, within this website, by following the ‘Book Now’ link. Alternatively, payment can be made by telephone or bank transfer. By applying for a Course, a Student is deemed to have accepted these Terms and Conditions.

3.2 It is the Student’s responsibility to ensure that The Academy fees in respect of the Course (as stated on the website and in other course publicity) and all other fees and expenses relating to the Course (some of which may be subject to a separate agreement) are paid by the deadline notified. The Academy reserves the right to refuse admission to any Student who has not paid all Fees in full before the course starts and as a place has been reserved will be liable to payment.

3.3 All payments must be made in GB Pounds Sterling. Any currency conversion costs or other charges incurred in making the payment or in processing a refund shall be borne by the Student or the third party making payment, and shall not be deductible from the Fees due to The Academy.

 

4.0 Cancellations and refunds

(A) Cancellation by you within fourteen days.

4.1. You have the right to cancel the contract for a place on a Course at any time within fourteen days, commencing from the day of our acknowledgement email or letter. In such instance, you will receive a full refund of the price paid for the Course.

4.2 If you book a course that is due to commence within 14 days of our acknowledgement, and then wish to cancel, there will be no refund.

4.3 If the course has commenced or been concluded, there is no right to cancel. Payment will still be due and payable if a Course place has been allocated and you fail to attend.

4.4 To cancel a contract, you must notify us in writing, addressed to the Course Administrator at The Broking Academy Ltd 130 Fenchurch Street, London, EC3M 5DJ. Or by email to, bookings@thebrokingacademy.com.

(B) Cancellation by you after fourteen days

4.5 If you cancel your place on a Course at any time after expiry of the fourteen-day period, there will be no refund, save in exceptional circumstances, at the discretion of the Course Director. In the event that a refund is given an administration fee may be deducted. If payment is unpaid at this time, it will remain fully due, payable and legally enforceable.

4.6 In exceptional circumstance you may be able to transfer your enrolment to a different course, or substitute a different Student onto the same course and subject to any administration fees. Course fees already paid can be transferred to the new course, and any outstanding balance must be paid in full before the Student can be registered on the new Course. No refund will be given if the cost of the new Course is less than the cost of the original Course.

4.7 To cancel a contract after fourteen days, or to transfer or substitute someone else, please notify us in writing, addressed to the Course Administrator at The Broking Academy Ltd, 130 Fenchurch Street, London, EC3M 5DJ explaining your reason for requesting the cancellation, details of the course you wish to cancel and your booking reference.

(C) Cancellation by us

4.8 We will make all reasonable efforts to deliver the Course as outlined on the website and in any brochure. However, we reserve the right to:

make reasonable adjustment to the timetable, location or presenters specified for a Course; and

make reasonable amendments to the content and syllabus of a Course when necessary.

4.9 We reserve the right to cancel any Course by giving you notice in writing at any time before the Course is due to start. We will refund all fees paid by you and will endeavour to offer a transfer to another Course as an alternative, subject to payment or refund of any difference in purchase price.

4.3.3 The maximum liability of The Academy will be limited to a refund of received fees for the cancelled Course, for partial cancellation of a Course; such refunds will be made on a proportionate basis. The Academy accepts no liability for any costs or losses incurred by Students or any other party which are claimed to have arisen through Course cancellation, other than as indicated in our Terms and Conditions. A Student is encouraged to arrange suitable insurance against cancellation of any Course if travel or other costs are likely to be substantial.

4.3.4 All deposits are non-refundable. If a Course is due to commence within 14 days, the full amount is due and payable by you.

 

5.0. Security

5.1 All payment details which are entered through this payment gateway are encrypted when the Student, or third-party making payment, enters them. The site is secure and uses 128-bit encryption to offer secure communications by encrypting all data to and from the site.

5.2 The Academy accepts no liability for any failure by the Student or third-party making payment of Fees to properly protect data from being seen on their screen by other persons or otherwise obtained by such other persons, during the Online Payment process or in respect of any omission to provide accurate information in the Course of the Online Payment Process.

 

6.0 Visual and/or audio recordings

6.1 We may take visual and/or audio recordings of Students during the Course and reserve the right to use these for promotional, management or educative purposes. Your consent for this will be assumed to have been granted unless you inform us to the contrary, in writing or by email, prior to the start of the Course.

 

7.0 Acceptable behaviour

7.1 In the interests of all Course participants, the organizers reserve the right to enforce the removal of any Student from the Course whose behaviour or demeanour is, in their view, considered unacceptable.

 

8.0 Discount codes

8.1 Codes cannot be used in conjunction with any other offer and only one code may be used per Student for Day and Weekend events.

 

9.0 Variations to the Terms and Conditions

9.1 The Academy reserves the right to vary these Terms and Conditions from time to time and the current version will be that published on the website.

 

10.0 Internship Promise

10.1 We promise on successful completion of a Course undertaken you, and you having achieved the required exam pass mark (75{3884670c9ed8fc2ab9184f5756d4ca50e4ae549f9bfbdcbc28501b67b7be24b3} Pass Mark) that we will place you at a prominent UK stock brokerage on a 4-week Voluntary Internship.

10.1 We reserve the right to refuse students access to a voluntary internship based on exams results.

10.2 We expect Students to be offered a job at the end of the Placement depending upon their level of achievement on the Course and if the Student meets all other criteria of the organisation operating the Placement.

10.3 The Academy cannot be held liable for any matters external to us. We cannot affect or influence relationships between a Student and partner companies.

 

11.0 Force majeure

11.1 The Academy shall not be liable to the Student or any other party for failure to perform any obligation caused by Acts of God, fire, flood, war, insurrection or civil disorder, requirements imposed by or pursuant to Government Regulation, or civil or military authorities, or by circumstances reasonably beyond the control of The Academy or partner companies.

12. Law

12.1 This Agreement shall be governed by and construed in all respects in accordance with the laws of England and Wales.
